1 Scope of application

MS Sports AG organizes - in cooperation with the “Verein zur Förderung Kids und Sport” - the MS Sports Camps (hereinafter referred to as Camps). These GTC apply to the respective camp. The contractual partner is on the one hand MS Sports AG - in cooperation with the “Verein zur Förderung Kids und Sport” (hereinafter referred to as VFKS) - and on the other hand the participating child and the legal guardian.

2 Registration

Registration for the MS Sports and VFKS camps must be made in good time by the legal guardian(s). Registration by telephone is also binding. After receipt of the registration you will receive a written confirmation as well as an invoice for the transfer of the participation fee (by e-mail). If the confirmation does not arrive automatically, you are obliged to contact the administration department (in writing to info(at)mssports.ch or by telephone on 041 260 33 67). Without a confirmation, there is no right to participate in the camp if the camp is fully booked. Every registration received is binding, even if for some reason you do not receive the confirmation e-mail in your e-mail inbox.

3 Participation fees and terms of payment

Participation in the MS Sports / VFKS camps offered is subject to participation fees, which can be found on the MS Sports AG website and in other documents. The participation fees must always be transferred before the start of the camp. If the participation fees are not paid in advance, the right to participate expires; the obligation to pay is then governed by section 4 below. A processing fee of CHF 20 is due on the second reminder.

4 Cancellations with cancellation insurance

4a Conditions
Registration is binding. It cannot be transferred to another child at a later date. Cancellation is mandatory if a child is unable to attend. Cancellations will only be accepted in writing by e-mail (to info@mssports.ch) and must also be confirmed in writing by MS Sports. By taking out cancellation insurance of CHF 26, participants can cancel their registration free of charge (up to 72 hours before the start of the camp). Camp fees already paid will be refunded in full. With the cancellation insurance, additional orders (e.g. a rain jacket for the soccer camp) can also be canceled free of charge if there is no longer a need for the ordered item.

4b Cancellation deadline
Cancellations can be made up to 3 days / 72 hours before the start of the camp (usually Friday 9:30 a.m.) without giving reasons, and a doctor's certificate must be enclosed in the event of cancellation shortly before the start of the camp due to illness, injury or accident. In this case too, the camp fee will be refunded in full. If you cancel later than three days / 72 hours before the camp without good reason (such as illness, injury or accident), the full camp fee will be charged (e.g. soccer camp CHF 315.-). By taking out cancellation insurance, the fee is reduced to CHF 50 per participating child. Rebooking to another camp in the same year is possible free of charge. If the camp is not canceled in writing (e.g. if the camp participation was forgotten), the full camp fee will be charged (e.g. soccer camp CHF 315.-). By taking out cancellation insurance, the fee is reduced to CHF 100 per participating child.

4c Missed camp days
If individual days of the camp are missed due to illness, injury, accident or other plausible reasons, the missed camp day will be refunded on a pro rata basis, taking into account services already received (e.g. camp dress). Cancellations due to vacation are not considered plausible reasons and therefore no price reduction will be granted. Refunds for misconduct of the participating child are excluded.

Riding camp: CHF 80 per missed camp day
Snowcamp: CHF 80 per missed camp day
Camps with additional supervision: additional CHF 15 per missed module

4d Cancellation by organizer
If the camp cannot take place due to official orders, force majeure, pandemics or epidemics, participants with cancellation insurance will be refunded the participation fees paid. However, the CHF 26 for the cancellation insurance is due for payment in any case.

5 Cancellations without cancellation insurance

5a Conditions
Registration is binding. Cancellations will only be accepted in writing by e-mail (to info@mssports.ch) and must also be confirmed in writing by MS Sports.

5b Cancellation deadline
Cancellations up to 30 days before the camp cost CHF 120. Later cancellations up to three days / 72 hours before the camp cost CHF 180. Cancellations made less than 72 hours before the start of the camp will be charged in full. Unexcused absences will result in the camp fee having to be paid in full. In the event of cancellation due to accident or illness before the start of the camp, we will refund the amount paid (minus a processing fee of CHF 30) upon receipt of a medical certificate. If the camp fee has not yet been paid, the processing fee of CHF 30 will be charged. Cancellations due to weather conditions or other reasons will not be refunded.

5c Missed camp days
If the participant is unable to take part in the camp activities for more than 2 days during the camp due to accident or illness through no fault of his own, he is entitled to a partial refund. The fixed costs due and the processing fee cannot be refunded. In the event of early return home due to accident or illness (through no fault of the participant), a refund will also be made for absences of more than 2 days. If more than 2 days of the camp are missed due to illness, injury or accident or other plausible reasons, the missed camp day will be refunded pro rata after deduction of the processing fee and taking into account services already received (e.g. camp dress). Cancellations due to vacation do not count as a plausible reason, which means that there is no price reduction. Refunds for misconduct of the participating child are excluded.

Soccer camp: CHF 30 per missed camp day
Polysport camp: CHF 35.- per missed camp day
Dance camp: CHF 35.- per missed camp day
Racket camp: CHF 50 per missed camp day
Bike camp: CHF 50 per missed camp day
Gaming camp: CHF 50 per missed camp day
Outdoor camp: CHF 50 per missed camp day
Riding camp: CHF 60 per missed camp day
Snowcamp: CHF 60 per missed camp day
Camps with additional supervision: additional CHF 15 per missed module

5d Cancellation by organizer
If the camp cannot be held due to official orders, force majeure, pandemics or epidemics, participants without cancellation insurance will be refunded the participation fee up to an amount of CHF 150, i.e. an amount of CHF 150 is due for payment even if the camp is not held, unless cancellation insurance has been taken out. In return for the mandatory payment of CHF 150, participants without cancellation insurance will receive a voucher for further MS Sports Camps in the amount of CHF 50 and a service package to be freely determined by MS Sports AG and VFKS (e.g. kit) if the camp is not held due to official orders, force majeure, pandemics or epidemics.

6 Vouchers / discounts

Vouchers purchased directly from MS Sports AG can be used indefinitely and for all offers carried out or invoiced by MS Sports AG. Vouchers are generally not transferable. If a voucher was won from MS Sports AG or one of its partners, it is only valid for as long as stated and can only be redeemed for the type of sport mentioned. Discounts can be obtained with a valid discount code. The discount is only granted if it is entered directly in the field provided when registering. Discounts are therefore not cumulative. No subsequent discounts will be granted on existing registrations. Discount codes can be used for all offers that are carried out or invoiced by MS Sports AG.

7 Liability in the event of accident / illness / property damage

Insurance is the responsibility of the participant. MS Sports AG and VFKS disclaim any liability for accident, illness or property damage of a participant to the extent permitted by law. In addition, the liability of MS Sports AG and VFKS is limited to the participation fee, provided that damage to the participant was not caused intentionally or through gross negligence on the part of MS Sports AG and VFKS and provided that MS Sports AG and VFKS is responsible for damage caused to the participant solely due to the fault of a service provider.

8 Liability for theft / loss

MS Sports AG and VFKS are not liable for the theft or loss of valuables or cash.

9 Information on the state of health

Registration confirms that the participant is healthy and fully able to exercise and can complete the training program without restrictions. The participant takes part in the training program on his/her own responsibility. Allergies and any necessary medication must be notified in writing to MS Sports AG and VFKS as well as the camp management before the start of the camp.

10 Implementation

The participant must follow the instructions of the coaching team and the camp management. If the instructions are repeatedly not followed, the camp management has the right to exclude the participating child from the training or the camp. In this case, there is no entitlement to a refund of the participation fee.

11 Cancellation of the camp

MS Sports AG and VFKS reserve the right to cancel the camp at any time against full reimbursement of the participation fee. If the camp cannot be held due to official orders, force majeure, pandemics or epidemics, the provisions in Art. 4 (with cancellation insurance) and Art. 5 (without cancellation insurance) of these GTC apply.

12 Photo/data and film rights

By registering, the participant and the person with parental authority declare their consent to the taking of photos and filming (data) of the participating child and their distribution and public presentation by MS Sports AG, the VFKS and its partners (including on the Internet), also for the purposes of their own advertising.

13 Advertising measures

MS Sports AG and VFKS do not pass on any data or addresses of participating families to third parties. However, we take the liberty of carrying out occasional advertising campaigns with our important sponsors in order to present their products and services. We make sure that the data of the participants is only used for attractive and appealing advertising measures. Thanks to the sponsors, it is possible to offer the camps at a reasonable price, which benefits the participants in particular. By registering, you agree that you may be contacted by a sponsor (e.g. CONCORDIA). You are entitled to prohibit MS Sports and the sponsors from using your address data. To do so, send an e-mail with your contact details to info(at)mssports.ch with the subject “Opting-out option”. This opt-out applies per camp and must be repeated in the event of a new registration for another camp.

14 Invalidity

Should individual provisions of these GTC be invalid, they shall be replaced by provisions that come as close as possible to the intended economic purpose. The remaining provisions shall remain valid unchanged.

15 Place of jurisdiction

These GTC shall be governed exclusively by Swiss law. The exclusive place of jurisdiction is Rickenbach (LU).
